The Polish version of these terms is binding; this translation is provided for convenience.
These terms and conditions apply from [EFFECTIVE DATE]. They govern sales in the online shop at spawlab.pl.
§ 1 General provisions
The spawlab.pl online shop is operated by [FULL COMPANY NAME], [LEGAL FORM], with its registered office at ul. Akacjowa 15, 63-700 Krotoszyn, VAT number [VAT NUMBER], REGON [REGON], entered in [KRS OR CEIDG, NUMBER AND REGISTRY AUTHORITY].
Contact with the Seller: telephone +48 669 162 833, email sklep@spawlab.pl, address for correspondence and returns ul. Akacjowa 15, 63-700 Krotoszyn. The office works from Monday to Friday between 8 and 16.
These terms set out the rules for concluding contracts of sale through the Shop, the rights and obligations of the parties and the complaints procedure. They are available on the Shop website in a form that can be downloaded, saved and printed.
The Customer is obliged to use the Shop in accordance with the law and not to supply unlawful content.
§ 2 Definitions
- Seller, the entity identified in § 1.
- Shop, the online shop at spawlab.pl.
- Customer, a natural person, a legal person or an organisational unit without legal personality who places an Order.
- Consumer, a natural person concluding a contract unconnected with their business or professional activity.
- Sole trader with consumer rights, a natural person running a business who concludes a contract directly connected with that business, where the content of the contract shows that it is not of a professional character for that person.
- Goods, an item offered in the Shop, including a new machine, a used machine, a welding consumable, an accessory and a part.
- Order, a declaration of intent by the Customer aimed at concluding a contract of sale.
- Working days, days from Monday to Friday excluding public holidays.
§ 3 Technical requirements
To use the Shop you need a device with internet access, a current browser with JavaScript and cookies enabled, and an active email account.
The Seller takes technical measures appropriate to the risks in order to protect the data transmitted in the Shop. Transmission takes place over an encrypted connection.
§ 4 Placing orders
Information about Goods on the Shop pages is an invitation to conclude a contract, not an offer within the meaning of the Civil Code.
You place an Order by adding Goods to the basket, completing the form and choosing the delivery and payment method. An Order can be placed without creating an account. It can also be placed by telephone or by email, in which case the Seller confirms the terms in writing before accepting the Order.
Before confirming the Order the Customer sees the total price of the Goods, the delivery cost and the payment method. Clicking the button stating the obligation to pay constitutes the placing of an Order.
The contract of sale is concluded at the moment the Seller sends confirmation to the Customer's email address that the Order has been accepted for processing.
Used machines are unique items. If the same unit has already been sold through another channel, the Seller informs the Customer without delay and refunds the money paid or proposes another unit. The Customer is under no obligation to accept the proposal.
Every used machine is checked by the Seller in the Seller's own service centre to current standards. The Seller describes the condition of the unit in the product listing: the result of the check, the list of replaced parts and photographs of the actual unit. Signs of use visible in the photographs are not a defect of the Goods.
§ 5 Prices and payments
Prices in the Shop are given in Polish zloty. For every item both the net price and the gross price including VAT are shown. The price does not include delivery costs.
The binding price is the price at the moment the Order is placed. The Seller may change prices and run promotions and sales, which does not affect Orders already placed. Where a price is reduced, the Seller states the lowest price from the 30 days before the reduction.
Available payment methods: traditional bank transfer to account [BANK ACCOUNT NUMBER] held at [BANK NAME], fast online transfer and BLIK through the payment operator PayU, instalments under the eRaty service, leasing through LeaseLink, and deferred payment transfer for businesses after verification.
Where payment is made in advance, the Customer pays the amount due within 5 working days of the contract being concluded. After that period the Seller may withdraw from the contract, having first called on the Customer to pay.
The Seller issues a VAT invoice for every Order and sends it in electronic form to the Customer's email address. The Customer accepts electronic invoices. The Seller issues a paper invoice on request.
A sale to a business from another European Union country holding an active EU VAT number is settled as an intra-community supply of goods at 0 percent, once the conditions of the Act on Value Added Tax are met, including documenting the transport of the Goods outside the territory of Poland.
§ 6 Delivery
The Seller delivers Goods within the territory of Poland and to all other European Union countries. The cost and time of delivery outside Poland are agreed by the Seller with the Customer before the Order is accepted.
Delivery methods: DPD courier for parcel shipments, Raben pallet transport for machines and oversized shipments, collection in person at ul. Akacjowa 15, 63-700 Krotoszyn by appointment.
The approximate delivery time from dispatch is 1 to 2 working days for the courier and 2 to 5 working days for pallet transport. The dispatch date is given in the product listing or in the Order confirmation.
The Customer sees the delivery cost in the basket before placing the Order. The cost depends on weight, dimensions, the place of delivery and the payment method chosen.
The risk of loss of or damage to the Goods passes to the Consumer at the moment the Goods are handed over to the Consumer. For other Customers it passes at the moment the Goods are handed over to the carrier.
The Seller recommends checking the condition of the shipment on delivery and drawing up a damage report with the carrier if the packaging or the Goods are damaged. The absence of a report does not take away the Consumer's rights, but it makes pursuing claims against the carrier more difficult.
§ 7 Withdrawal from the contract
A Consumer and a sole trader with consumer rights may withdraw from a distance contract without giving a reason within 14 days of taking possession of the Goods.
To meet the deadline it is enough to send the statement before it expires. The statement may be made in any form, including by email to sklep@spawlab.pl or in writing to the Seller's address. The template form from the annex to the Consumer Rights Act may be used, but this is not obligatory.
The Customer returns the Goods without delay, and no later than 14 days from the day of withdrawal. The direct cost of returning the Goods is borne by the Customer. For oversized Goods that cannot be sent back as an ordinary postal item, the cost of return corresponds to the price of pallet transport and depends on the distance.
The Seller refunds the payments, including the cost of delivering the Goods to the Customer at the level of the cheapest ordinary delivery method offered in the Shop, within 14 days of receiving the statement. The Seller may withhold the refund until the Goods are received or proof of their return is provided.
The Customer is liable for any reduction in the value of the Goods resulting from using them in a way going beyond what is necessary to establish their nature, characteristics and functioning.
The right of withdrawal does not apply in the cases set out in Article 38 of the Consumer Rights Act, including where the subject of the contract is non-prefabricated Goods made to the Customer's specification or serving to meet their individualised needs.
§ 8 Complaints and lack of conformity of goods with the contract
The Seller is obliged to deliver Goods in conformity with the contract. Towards a Consumer and a sole trader with consumer rights the Seller is liable for a lack of conformity of the Goods with the contract on the terms of Chapter 5a of the Consumer Rights Act.
For used Goods the parties may agree a shorter period of the Seller's liability than two years, provided the Customer was informed of this before the contract was concluded. The period applied by the Seller to used Goods is 12 months from the day the Goods are handed over. For new Goods the statutory period applies.
Towards Customers other than those listed above, that is businesses buying in connection with activity of a professional character, the Seller's liability under the statutory warranty for defects is excluded on the basis of Article 558 paragraph 1 of the Civil Code. This does not limit the Seller's obligation to deliver Goods in conformity with the Order, nor liability for the fraudulent concealment of a defect.
A complaint is submitted by email to sklep@spawlab.pl or in writing to the Seller's address. The report should contain the Order or invoice number, a description of the non-conformity, the serial number of the Goods and the Customer's demand.
The Seller deals with a complaint within 14 days of receiving it and informs the Customer of the outcome. No reply within that period means the complaint is upheld, unless a specific provision states otherwise.
If the complaint is upheld, the cost of transporting the Goods to the Seller and back is borne by the Seller. The Seller does not accept shipments sent cash on delivery.
§ 9 Manufacturer warranty and service package
New machines are covered by a manufacturer warranty on the terms of the warranty card supplied with the Goods.
The Seller gives no commercial warranty on used machines. Every unit is checked in the Seller's service centre to current standards, and the price of the machine includes the first year of the basic service package. The Customer may buy further years of the package, which covers cheaper repairs, a periodic inspection, priority in the service queue and an inspection report. The scope of the package is set out in the product listing and in the sales document.
The service package is a service. It does not cover wearing parts, mechanical damage, the effects of operation on an incorrect power supply, flooding, overheating, or repairs carried out outside the Seller's service centre.
Neither the manufacturer warranty nor the service package excludes, limits or suspends the Customer's rights arising from a lack of conformity of the Goods with the contract.
§ 10 Personal data
The controller of Customers' personal data is the Seller. Data are processed on the basis of the GDPR, for the conclusion and performance of the contract, the issue of accounting documents and the handling of complaints, and on the basis of legitimate interest and consent, where consent has been given.
Providing data is voluntary, but without it the conclusion and performance of the contract is not possible. The Customer has the right to access their data, to rectification, erasure, restriction of processing, portability, objection, and to lodge a complaint with the President of the Personal Data Protection Office.

§ 11 Out of court dispute resolution
A Consumer may use out of court methods of handling complaints and pursuing claims.
- Mediation at the provincial inspectorate of the Trade Inspection.
- The permanent consumer arbitration court at the provincial inspectorate of the Trade Inspection.
- Free assistance from a district or municipal consumer ombudsman.
- Assistance from social organisations whose statutory tasks include consumer protection.
Information on the procedures is made available by the Office of Competition and Consumer Protection at uokik.gov.pl.
The European online dispute resolution platform ODR ceased operating in 2025 and does not accept new submissions. A Consumer from another European Union country may turn to the European Consumer Centres Network.
Use of the out of court route is voluntary for both parties.
§ 12 Final provisions
In matters not governed by these terms, Polish law applies, in particular the Civil Code, the Consumer Rights Act and the Act on the provision of services by electronic means.
The Seller may amend these terms for important reasons, including a change in the law or a change in the payment or delivery methods. The Seller gives notice of a change on the Shop website 14 days in advance. Orders placed before the change are governed by the terms in their previous wording.
Disputes with a Customer who is not a Consumer are settled by the court having jurisdiction over the Seller's registered office. Disputes with a Consumer are settled by the court having jurisdiction under the general rules.
If any provision of these terms proves invalid, the remaining provisions remain in force.
